Can I Build a Garden Office Without Planning Permission?

Usually, yes — garden offices, studios, gyms, and other outbuildings are permitted development under Class E of the GPDO 2015, as long as they are “incidental to the enjoyment of the dwellinghouse” and meet the size and height limits.

The key limits:

  • Max height (dual pitch): 4 metres
  • Max height (any other roof): 3 metres
  • Max eaves height: 2.5 metres
  • If within 2m of a boundary: max overall height 2.5 metres
  • Total coverage: outbuildings (plus all other extensions and buildings) must not cover more than 50% of the curtilage
  • Position: cannot be forward of the principal elevation

The “incidental use” rule

A garden office used for working from home is generally considered “incidental” to the dwelling and does not need planning permission. However, if the outbuilding becomes the primary location of a business — for example, you employ staff who work from it, clients regularly visit, or it operates as a commercial premises — it may constitute a change of use and require planning permission.

The line can be blurry. A good rule of thumb: if you are using it for your own remote work and it supports your home life, it is incidental. If it operates more like a standalone commercial premises, it probably is not.

Conservation area restrictions

On designated land (conservation areas, AONBs, National Parks), outbuildings:

  • Cannot be placed to the side of the house
  • Cannot be placed between the house and the highway
  • Are subject to the same height limits but face stricter scrutiny

When you will need planning permission

  • The outbuilding exceeds the height limits
  • Total coverage exceeds 50% of the curtilage
  • The outbuilding is forward of the principal elevation
  • Your property is a listed building
  • It includes sleeping accommodation (this removes PD rights entirely)
  • It is not “incidental” to the dwelling (business use, separate dwelling)

Building regulations

Outbuildings are exempt from building regulations if:

  • Under 15m² — exempt with no conditions
  • 15–30m² — exempt if single storey, contains no sleeping accommodation, and is either at least 1m from any boundary or built of non-combustible materials
  • Over 30m² — building regulations required

If your garden office is over 30m² or includes sleeping accommodation, you will need building regulations approval.
